Terms and Conditions

These Terms and Conditions apply to all bookings made with OPAL Cruises (“OPAL Cruises”, “we”, “us”, “our”). By making a booking or enquiry for a charter with OPAL Cruises, you agree to the following terms. 1.

1. Bookings

All charter bookings are subject to availability and confirmation by OPAL Cruises. A booking is confirmed once a 50% deposit of the total charter fee has been received and written confirmation has been issued by OPAL Cruises.

2. Payments

A 50% deposit is required to secure all charter bookings. The remaining 50% balance must be paid no later than 7 days prior to the charter date unless otherwise agreed in writing. Failure to complete payment within the required timeframe may result in cancellation of the booking and forfeiture of the deposit. All prices are quoted in Australian Dollars (AUD) unless otherwise stated.

3. Guest Capacity

In accordance with maritime safety regulations, a maximum of 12 guests are permitted onboard, including the skipper. The number of guests must not exceed this limit under any circumstances. OPAL Cruises reserves the right to refuse boarding to any additional guests if this limit is exceeded.

4. Guest Conduct

All guests must behave in a safe and respectful manner during the charter. OPAL Cruises reserves the right to refuse boarding or terminate a charter if guests behave in a disorderly or unsafe manner, fail to follow crew instructions, or pose a risk to the vessel, crew, or other passengers. No refunds will be issued if a charter is terminated due to inappropriate conduct.

5. Safety

Guests must follow all safety instructions provided by the skipper and crew at all times. Children must be supervised by a responsible adult throughout the charter.

6. Weather

Charters operate in most weather conditions. However, OPAL Cruises reserves the right to delay, modify, or cancel a charter if weather conditions are considered unsafe. All safety decisions are made at the discretion of the skipper.

7. Liability

Guests participate in charters at their own risk. OPAL Cruises will not be held liable for personal injury, loss or damage to personal belongings, or delays caused by circumstances beyond our control.

8. Damage to Vessel

The person making the booking is responsible for any damage caused to the vessel, equipment, or furnishings by members of their party during the charter. OPAL Cruises reserves the right to recover repair or replacement costs where necessary.

9. Amendments

OPAL Cruises reserves the right to update or amend these Terms and Conditions at any time. The Terms and Conditions in effect at the time of booking will apply to that booking.
